Walter Isaac NATHAN + Amelia JOSEPH - Wellington

WALTER ISAAC NATHAN (1845-1922)
was born 27 Nov 1845 in Launceston, Tasmania, Australia, the oldest of (at least) 9 children of Arthur Isaac NATHAN (1814-1863) & Caroline COHEN (1827-1881), originally of London. They returned to London when Arthur was about 5. He was schooled there and was trained to be a businessman (his parents remained & died in London). He came out to New Zealand in the 1880s, working first in Dunedin for a year then settled in Wellington. He was manager of Bannatyne & Co., merchants and shipping agents and was also president of the Wellington Hebrew Congregation from 1887 to 1889

* Walter's siblings who are known at this time to have also settled in NZ are: 'Arthur' Hyam Nathan (1847-1905, Auckland), Edward Lionel Nathan (1851-1903, Auckland), Sydney Jacob Nathan (1860-1917, Auckland)
* further research would, I'm sure, reveal a connection to the famous & oldest business in New Zealand, L. D. Nathan which was established in the 1840s by
David Nathan (1816-1886) for his son Laurence David Nathan (expanded to own supermarket chains Super Value & Woolworths & started Big Fresh, Price Chopper and Deka), and was sold in 1988, merging with Lion Breweries

The beautiful rooms were charming with flowers, very fine ranunculus being arranged on the tea-tables in the dining room, where refreshments were served by the daughters of the hostess. A guest, who, all unconscious, was an entirely successful addition to the party, was Mrs Hubert Nathan's little daughter, Joyce, who was in all the dainty bravery of muslin and lace. Widespread regret will be felt at the news of the death, which occurred at an early hour this morning, of Mr Walter Nathan, for many years prominent in the business world of the Dominion, and an old and much-respected citizen of Wellington. The late Mr Nathan was born in Tasmania in 1846, and at the age of five went to England with his parents. He was educated at the University College School, London, for a business career. He came out to New Zealand in the 'eighties and started business first in Dunedin. He was there for about twelve months, and then joined the firm of Messrs L. D. Nathan, of Auckland, where he remained for some seven years.
Coming to Wellington, he was for a time in the hardware trade. In 1894 he went into partnership with Mr Harold Beauchamp in the firm of W. M. Bannatyne and Co., and continued there until his death. He was always interested, but took no active part in local or national politics. For some years he was Consul in Wellington for Sweden. At one time he was a prominent member of the Wellington Bowling Club.
He married the eldest daughter of the late Mr Jacob Joseph, and leaves to mourn their bereavement a widow, four sons - Mr Hubert Nathan, director of Messrs Bannatyne and Co., Percy Nathan, who is farming in the Wairarapa, George Nathan, real estate agent and Stanley Nathan, sharebroker at Gisborne - and five daughters, of whom Miss Sybil Nathan is at present at Home as delegate to the Red Cross Convention.
The late Mr Nathan tokk a leading part in the social life of the Jewish community and was president of several institutions, including the Jewish. He had been ill only a few days before his death

... There are many people in the Dominion who will hear with great regret of the sudden death of Mrs Walter Nathan, of Wellington, the cabled news of which has been received from London, Mrs Nathan was the eldest daughter of the late Mr Jacob Joseph, a pioneer resident of Wellington and leaves a family of nine sons and daughters. Mrs Nathan was a most kindly, hospitable and philanthropic woman, and one of the chief workers for the Red Cross from the outset of the war. She was one of those who attended the first meeting called by Lady Godley and Lady (the Mrs) Luke, the Mayoress of Wellington, to make arrangements for Red Cross assistance in war time, and was a steady worker throughout the whole strenuous time.
Mrs Nathan was a continuous member of committee and vice-president of the Red Cross, following on to the peace-time committee, and full of kindness to those at the Red Cross Home, when they were situated at Trentham and afterwards at Hobson street.
The late Mrs Nathan was a member of the Sydney Street Soldiers' Club Committee, and a regular helper at the big evenings which were held there, and were such a feature of the lives of the trainees at Trentham.
Lady Luke pays a heartfelt tribute too to the general and continued kindness and generosity of Mrs Nathan, stating that she was always ready not only to give monetary assistance to those in distress but to give personal sympathy and effort, and Lady Luke adds a personal regret that another of the band of splendid workers who spent about eight years together at the Town Hall at Wellington has passed on, leaving a place that will be very difficult to fill. Much sympathy will be felt for the family of Mrs Nathan in their sudden bereavement.

DEATH, November 1899 - Mr. Archibald Merlet (eldest son of Mr. Augustus Francis Merlet and brother-in-law of Mr. E. FOCKE, German Consul here) died suddenly on the 10th instant. The deceased was at one time a prominent figure in athletic circles in Wellington. He was one of the founders of the Poneke Football Club, and was also a cricketer. For some years he was in the employ of Messrs. J. E. Nathan and Co. and Castendyke and Focke, and afterwards he was license of the Clyde-quay Hotel. About two years ago he went to Victoria, and at the time of his death he was on the staff of the Bendigo Pottery Co. The cause of death was syncope. Deceased, who was only 33 years of age, was married to a daughter of Mr. Chas. Knigge, of Wellington

From the EVENING POST 31 August 1904 The Chief Justice was occupied this morning with a case stated between, on the one hand, Mary Jane Jillett, of Porirua, widow, and Herbert John Jillett, of Ohau, Farmer (executors of the will of the late William Jillett, of Porirua, sheepfarmer), and, on the other side, the Commissioner of Stamps. Testator was a half-caste, and his children are by a white woman, his wife; part of his estate in native land. The difficulty arose in deciding whether the beneficiaries are native or European; on their status and that of the land hinges the question of what duty is payable. The sum of ?241 had already been paid on the whole estate, including the native land, under the Deceased Persons' Estates Duties Act 1881; the Commissioner claimed a further 10 per cent, on the value of the native land, under section 17 of the Stamp Duty Amendment Act 1885. The question for the Court was whether duty was payable under the last-mentioned Act. Mr. Beere, for the executors, contended that the devise under the will was not a 'devise in fee' under the section, and he made the further submission that where the language of the statute was doubtful, it should be liberally construed in favour of the subject as compared with the Crown. He detailed the several Acts dealing with stamp duty and deceased persons' estates, and showed that under one of them a child of deceased would be a native, under another a European, and so on. Mr. Myers, for the Commissioner, replied on the points of law. The Court reserved judgment.

Judgment was given by his Honor the Chief Justice on Wednesday morning in the appeal Mary Jane Jillett and Herbert John Jillett v. the Commissioner of Stamps. Plaintiffs are the wife (European) and son of the late Wm. Jillett (half-caste), and under deceased's will are trustees to convert his land and divide the proceeds among deceased's wife and children, as provided in the will. Section 17 of the Stamp Act, 1882, Amendment Act, 1885, provided that an additional duty of 10 per cent be levied on every 'conveyance on sale or devise in fee' of native land, "whereby the right to such land shall first vest in a person other than a native." His Honor said that deceased, being a half-caste, was a "native" under the Act mentioned, and that there is a "devise in fee" to persons (the trustees) who are not "natives" under the Act, but that it is not a "devise in fee whereby the right to the land vests" in the said trustees. The "right" to the land did not vest in the trustees. They could not have given a title to a purchaser without obtaining probate of the will from the Native Land Court. The transaction therefore did not come within the terms of the section. The appeal must be allowed with ?10 10s costs. In the course of his judgment, his Honor remarked that the Court is concerned only with the interpretation of the statute, not with the possible harshness of a provision that if a native leaves his property to his children, and the mother is a European, the children have to pay, in addition to the ordinary duties payable by Europeans, a 10 per cent, duty beyond.

At St Peter's Church, Wellington, on Wednesday afternoon last week, Mr W. G. Somervile, solicitor, was married to Miss Lydia Eloise Hare. The bride, who was given away by her father Mr. W. M. Hare, was attired in a lovely gown of white duchesse satin, with an overdress of chiffon and lace and a gull court train. She also had a wreath of orange blossoms and a veil, and carried a lovely white shower houquet.
The bride was attended by four bridesmaids, namely Miss Adeline Hare (sister of the bride), who was dressed in white silk, and wore a Victorian bonnet trimmed with white chiffon and pink roses, and carried a shower bouquet of pink roses; Mrs Dorothy Hare and Maud Somerville (nieces of the bride and bridegroom), who were both dressed in white silk and Victorian bonnets; and Miss Phyllis Howard (niece of the bride), who had on a lovely Empire dress of white silk and chiffon, and a Victorian bonnet of similar material. The three latter bridesmaids were little dots, from three to ten years of age, and carried shepherds crooks,
The bridegroom's gift to the bride was a diamond and opal ring and a gold necklace with a pendant of pearls, and the bridesmaids were each presented with gold chain necklaces with heart pendants.
The Rev. G. P. Davys conducted the ceremony, and Mr. H. H. Seed acted as best man, and Mr. F. C. Edwards as groomsman. The bride's going-away dress was of turquoise blue voile, trimmed with lace insertion, with a black picture hat to match.
The honeymoon is to be spent in Christchurch.
A large number of relatives and friends were present and the married couple were the recipients of many presents, including one from the principas and staff of Messrs. Morison and Loughnan in whose office Mr. Somerville had been for many years.
The bride's gown was designed and made by Miss Watson, of the staff of Kirkcaldie and Stains

VICTOR MALDON CLAPP was born in Ballarat, Victoria (as was Ernest's mother) on 20 Nov 1897, a son of ALbert Edward CLAPP & Margaret Ann HOPE. He died 8 August 1972. He is buried in Drouin Cemetery. His (at least 2nd) wife, Louisa RENDELL (born in Warragul, Victoria) died 25 July 1966 aged 77. She is also buried at Drouin cemetery. Her headstone reads:

... a most extraordinary position has arisen in connection with a child, and while Hare is clapping the paternity on to Clapp, the latter claims that Hare is the father and Hare refuses to be chased out of the camp. Sergeant Lander, who appeared for the Education Department against Ernest Gilbert Hare, respecting the maintenance of two children, and against Victor Maldon Clapp in respect to the maintenance of one child, the destinies of these two men having been thrown together through the marriage by one of the other's divorced wife. Really the pivot of the case was whether a child born to Mrs. Clapp two months after the marriage was Clapp's or Hare's.

There are many old Wellngton Navals as well as other friends, who will learn with regret, of the death of Mr Walter Maldon Hare, which occurred this morning after an illness, extending over some twelve months. The late Mr. Hare was born in London sixty-four years ago, and voyaged to Victoria in 1861, in which year he was married at Ballarat. In his capacity as printer and paper-ruler he joined the staff of Messrs. Shaw and Harnett, Invercargill, and on their behalf printed the first West Coast paper - the West Coast Times - at Hokitika, about thirty-six years ago. For over thirty years past, until a few months ago - when ill health compelled his retirement - the deceased gentleman was in the Government Printing Office, and for twenty-three years he was an active member of the Wellington Navals. His kind-heartedness won him many friends, and he was always prominently identified with the initation of funds by means of concerts and so on for the relief of persons in distressed circumstances. The late Mr. Hare leaves a widow and six children

... Sitting in civil jurisdiction, Mr. W. R. Haselden, S.M., gave reserved judgment at the Magistrate's Court to-day in the civil action brought by Cyril William Tanner, solicitor, and registered money-lender, of Wellington, against Francis Jane Hare and Ernest Gilbert Kimberley Hare, a claim for ?100 as balance of principal money alleged to be due by defendants to plaintiff under the provision of a mortgage executed by defendants in favour of Tanner. Defendants counter-claimed ?100 damages and costs of the action
- POINTS IN THE CASE
The Magistrate, in the course of a lengthy judgment, said that the bare facts of the case were as follows:- William George Somerville (a speculating solicitor in embarrased financial position, a son-in-law of Mrs. Frances Hare, not joined as a defendant, and now bankrupt), had borrowed money from Tanner, and was in arrears with both principal and interest, he was the third mortgagee of a property at Kelburne, over which Tanner held a second mortgage. Somerville had sub-mortgaged his third mortgage to a Mrs. Butler. Tanner sold the property through the Registrar, and bought it for less than was owing to him, thus rendering Somerville's third mortgage valueless, and, of couse, depriving Somerville's mortgagee, Mrs Butler, of her security. Tanner and Somerville arranged that Mrs Hare and her son, who together held a mortgage of ?1200 over some land at Island Bay, should join with Somerville in purchasing the Kelburne property ... read the case here
