Wairarapa Daily Times, 3 August 1899 The Masterton Magistrate's Court is occupied this afternoon in hearing an assault case adjourned from Carterton on Tuesday last. The plaintiffs in the case are Joseph Smugai and Peter Shutkefski and the defendants, Frank Max and his wife. The action is to recover damages for alleged assault by the defendants upon the plaintiffs on July 17th. Mr P. L. Hollings, who appeared for the plaintiffs, in opening his case, stated that a fence had been erected across Philip-street, Carterton, by the defendants, blocking the way, and the plaintiffs had endeavoured to remove the fence. In doing so they were attacked by the defendant Max, who was armed with a whip; Mrs Max, with an iron bar, and her daughter with a stout wooden plank. Shutkofski's right arm was injured to such an extent as to prevent him from following his usual employment for some time and the same thing happened to Smugai. A number of witnesses were called by Mr Hollings, who corroborated the plaintiff's story. At the close of the plaintiff's case the further hearing was adjourned to Masterton for to-day
Wairarapa Daily Times, 5 August 1899 Judgment was given in the Masterton Magistrate's Court this morning in the assault case. Mr H. W. Northcroft, who occupied the Bench said that there was no doubt that the road was a public highway, and the plaintiffs had a perfect right to enter upon the road. The defendants were in the wrong when they erected the fence across the road. With regard to the assault, His Worship said there was no doubt that the road had been barricaded by the defendants. At the same time the plaintiffs must have known that, when they went to take away the fence, there must be a row. Certainly the defendants had no right to commit the assault. The story of the axe, was, in the Court's opinion, a made up one, after the assault. The plaintiffs were entitled to damages, but not to the extend of £20, as claimed. Judgment was accordingly given for the plaintiffs for £5 in each case (2013 equivalent of $875), with solicitor's fee £1 1s, and witnesses expenses according to scale

Dorothy Anne Lakin Died 02.11.1998 Hokitika but also found a Joesph Max death in Hokitika 17.03.1949, not sure where this fits

Dorothy EDITH 'Dorrie' Lakin (nee Morgan)
She died 2 Nov 1998 aged 84 & is buried Plot 61, Block H at Hokitika
She was the wife of Eric Max Lakin (1908-1978 as above)
They are buried together
of note their son, George Max Lakin (1922-1955) died aged 22 and is buried Plot 4678, Block 200 also at Hokitika
